These Terms and Conditions govern your use of the Outcomes Tracking platform and services provided by Prosper Business Analytics Pty Ltd ("we", "us", or "our"). By accessing or using the platform, you agree to be bound by these terms.
Outcomes Tracking is a productivity analytics platform for face-to-face and field sales teams. You agree to use the platform only for lawful business purposes and in accordance with these terms. You are responsible for ensuring that all users within your organisation comply with these terms.
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorised use of your account. You are responsible for all activity that occurs under your account.
Outcomes Tracking is provided on a subscription basis at the rate current at the time of subscription. Pricing is company-based (not per user). Payment terms will be agreed at the time of subscription. We reserve the right to update pricing with reasonable notice.
There is no minimum contract term. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for unused periods within a billing cycle.
The Outcomes Tracking platform, including all software, design, content, and methodology, is the intellectual property of Prosper Business Analytics Pty Ltd. You may not copy, modify, distribute, or reverse engineer any part of the platform without our written consent.
Performance data entered into the platform by your team remains your data. We will not sell or disclose your organisation's data to third parties without your consent, except as required by law. See our Privacy Policy for full details.
To the maximum extent permitted by applicable law, Prosper Business Analytics Pty Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of or inability to use the platform. Our total liability shall not exceed the total fees paid by you in the 3 months preceding the claim.
These terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
